Regular Meeting
Mark Masinda called the meeting to order at 7:33.

Present:
Mark Masinda, Chairman
Richard Maloney
Brian Semprebon
Jack Rup

New Business:
R. Maloney motion to do new business first. J. Rup seconded the motion.  All voted in favor

ZBA2010-2 Application for a variance of section 8.01 to construction a deck and replace a window with a door to deck at 6 Kollar Road (Map 24 Lot 21 Zone R80) Owner/Applicant: William Jean (Received April 8, 2010 Public Hearing by June 10, 2010 Decision within 65 days after close of P.H.)

 Application was received; Public Hearing is set for June 10, 2010.

R. Maloney made a motion to approve minutes of the April 8, 2010
B. Semprebon seconded the motion. All voted in favor.


ZBA2010-1 Application for a variance of section 7.01.03 to construct a 7,410 sq ft horse stable/indoor riding area of which 1,140 sq ft is open but covered area and section 7.07.04.01 to allow fence to be put on property line at 1 Potter School Road (Map 49 Lot 2-0A Zone R80) Owner/Applicant: Earl & Michele Bancroft (Received January 14, 2010 Public Hearing March 11, 2010 decision within 65 days after close of P.H.)


M. Masindia opened the meeting for discussion on ZBA2010-1 application.

R. Maloney made a motion to approve the application to construct a stable and indoor riding area. B. Semprebon seconded the motion.
M.Masinda asked for discussion on the motion.
R. Maloney stated that the application was very well put together and presented to the Board.  He felt it was a very difficult application to work on.
The Board Member discussed in great detail many issue.
 The Board Members discussed the Plan of Conservation and Development and how the Town of Willington would like to support more agricultural use. They also talked about the size of the property, the uniqueness of the stable, the size of the building. How the structure far exceeds the size that the regulation allow. The Board Members had a discussed on the hardship? Was the hardship in the way the regulation was written?
J. Rup stated that the variance would stay with the property.
R. Maloney felt the regulation do not take into consideration the uniqueness of the application.
B. Semprebon wanted the size of the building add to the motion. A new motion was made.
B. Semprebon motion to approve the construction of a 7,410 sq ft horse stable with indoor riding area of which 1,140 sq ft is open but covered area as proposed in the application.
Motion to approve R. Maloney and B.Semprebon voted yes. J.Rup and M. Masindia voted no. Motion denied.
